These Terms of Service ("Terms") constitute a legally binding agreement between you, whether acting individually or on behalf of an organization ("you"), and QAlity ("we", "us", "our"), governing your access to and use of the QAlity platform, website, and all related services (collectively, the "Service"). These Terms apply to all users of the Service, including those accessing it through any interface, device, or integration.
By accessing, registering for, or using the Service in any manner, you confirm that you have read, understood, and agreed to be bound by these Terms. You further represent that you have the legal capacity and authority to enter into this agreement, and that your use of the Service will comply with all applicable laws and regulations. You retain full ownership of all data that you create, upload, or store within the Service. This includes test cases, test steps, input values, execution logs, and AI-generated outputs derived from your inputs. QAlity does not claim ownership over your data.
However, in order to provide the Service, you grant QAlity a limited, non-exclusive right to store, process, and use your data strictly for operational purposes. This includes running tests, generating outputs, and maintaining system functionality.
We do not use your data for advertising, resale, or external distribution. You remain fully responsible for the content you upload, including ensuring that you have the legal right to use and store such data.
7. Sensitive Data Handling
You may choose to include sensitive data, such as credentials or passwords, within your test cases. QAlity implements encryption for sensitive values stored in the database and does not store such values in plain text.
Despite these protections, you are responsible for determining what data you upload. You should avoid including unnecessary sensitive or confidential information unless required for testing purposes.
QAlity is not responsible for any consequences arising from the inclusion of sensitive data in your test cases. You acknowledge that you assume responsibility for such data.
8. AI Features and Limitations
QAlity provides AI-powered features designed to assist in testing workflows. These include Auto-Heal Recovery, AI Step Generation, and AI Case Variations. These features rely on automated systems to generate outputs based on your inputs.
AI-generated outputs may not always be accurate, complete, or suitable for production use. You acknowledge that AI operates probabilistically and may produce unexpected or incorrect results.
You are solely responsible for reviewing, validating, and approving any AI-generated content before using it. QAlity does not guarantee the correctness, reliability, or usefulness of AI outputs and is not liable for any consequences arising from their use.
Important. AI-generated test steps or fixes may be incorrect or incomplete. Always validate automation before relying on it in production pipelines.
9. Service Availability and Changes
QAlity is designed to provide a reliable and consistent experience; however, you acknowledge and agree that the Service is provided on an evolving basis. As an actively developing platform, features, infrastructure, and system behavior may change over time. While we aim to maintain high availability, we do not guarantee uninterrupted access to the Service at all times.
The Service may experience temporary interruptions due to maintenance, system upgrades, technical issues, or factors beyond our control. These interruptions may affect access to features, execution of test cases, or availability of AI-powered functionalities. You agree that such interruptions are a normal part of operating an online service and do not constitute a breach of these Terms.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes adding new features, removing existing features, or changing how the Service operates. Your continued use of the Service after such changes constitutes your acceptance of those changes.

11. Refunds and Cancellation
All fees paid for the Service are generally non-refundable unless required by applicable law. By purchasing a paid plan or feature, you acknowledge and agree that you are responsible for evaluating the Service before committing to payment.
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will prevent future billing but will not result in a refund for the current billing period. Access to paid features may continue until the end of the billing cycle.
It is your responsibility to manage your subscription, including tracking renewal dates and ensuring timely cancellation if you do not wish to continue. Failure to cancel before the next billing cycle may result in additional charges.

14. Limitation of Liability
To the fullest extent permitted by applicable law, QAlity shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to your use of the Service.
This includes, but is not limited to:

- Business interruption
- Errors or failures in test execution
- Inaccuracies in AI-generated outputs
These limitations apply regardless of the cause of action, whether in contract, tort, negligence, or otherwise. Even if QAlity has been advised of the possibility of such damages, we shall not be held liable.
